At omgcodex, we aim to provide clear, professional and high-quality digital services. Because our services often involve custom design, development, strategy and work performed specifically for each client, our refund policy depends on the nature and stage of the project.
This Refund Policy applies to services provided by omgcodex unless a separate written agreement, proposal or statement of work contains specific refund terms.
Nothing in this Refund Policy excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law (ACL) or other applicable laws where those rights cannot legally be excluded.
1. Custom Services
Our services may include custom:
- Website design;
- Website development;
- Website redesign;
- Branding and graphic design;
- SEO;
- Digital marketing;
- Website maintenance;
- Technical development; and
- Other digital services.
Because these services involve time, expertise and resources allocated specifically to each project, refunds are not automatically available simply because a client changes their mind after work has commenced.
2. Before Work Begins
If you cancel a project before work has started, we will review the circumstances and determine whether a refund is available.
Where a refund is approved, we may deduct reasonable amounts for:
- Work already performed;
- Administrative costs;
- Third-party costs already incurred;
- Software, licences or subscriptions purchased specifically for the project; and
- Other non-refundable costs reasonably incurred on your behalf.
Any specific deposit or cancellation terms agreed in your project proposal or contract will apply.
3. After Work Has Started
Once work has commenced, payments may become non-refundable to the extent they relate to work already performed or costs already incurred.
This may include:
- Research;
- Planning;
- Strategy;
- Design;
- Development;
- Content implementation;
- Configuration;
- Testing;
- Project management;
- Revisions;
- Third-party services; and
- Other work performed for the project.
If you cancel after work has started, we will assess the amount of work completed and any outstanding obligations before determining whether any amount is refundable.
4. Deposits
Where a deposit is required, the deposit may be used to reserve project time and begin work.
A deposit is not automatically refundable after work has commenced.
If you cancel before the project begins, we will consider the circumstances and any costs already incurred when determining whether some or all of the deposit can be refunded.
Nothing in this section limits rights that cannot legally be excluded under Australian law.
5. Completed Work
Once a service or project milestone has been completed and delivered or approved, the corresponding payment is generally non-refundable.
If you identify a genuine issue where the delivered work does not materially match the agreed project requirements, please contact us so that we can review and, where appropriate, correct the issue.
6. Revisions and Changes
A request for additional changes does not automatically create a right to a refund.
Where the original agreed scope has been completed and you subsequently request a different design, new functionality or a substantial change in direction, the additional work may be quoted separately.
We encourage clients to provide feedback during the agreed revision process so that issues can be addressed before final approval.
7. Client Delays or Lack of Communication
A refund will not normally be provided solely because a project is delayed due to:
- Missing content;
- Missing images;
- Delayed approvals;
- Delayed access credentials;
- Delayed feedback;
- Changes in requirements;
- Failure to respond to project communications; or
- Other circumstances caused by the client.
We may pause the project until the required information, access or feedback is provided.
8. Third-Party Costs
Some projects may require third-party products or services, such as:
- Domain registration;
- Website hosting;
- Premium plugins;
- Themes;
- Fonts;
- Stock images;
- Software licences;
- APIs;
- Email services; or
- Other external services.
Third-party charges may be non-refundable and are subject to the relevant provider’s own refund policy.
Where we purchase a third-party product or service specifically for your project, we may deduct any non-refundable amount from an approved refund.
9. SEO and Digital Marketing Services
SEO and digital marketing services involve work performed over a period of time and may include research, strategy, technical work, content, optimisation, reporting and other activities.
Fees for work already performed are generally non-refundable.
We do not provide refunds merely because:
- Search rankings do not increase as expected;
- Traffic does not reach a particular level;
- Leads do not reach a particular number;
- A website does not generate a particular amount of revenue; or
- A third-party platform changes its algorithm or policies.
No particular search ranking, traffic level, lead volume or business result is guaranteed unless expressly agreed in writing.
10. Website Hosting and Maintenance
Where hosting, maintenance or support is provided as an ongoing service, payments generally relate to the service period purchased.
If you cancel an ongoing service, cancellation will normally take effect at the end of the applicable paid service period unless a separate agreement provides otherwise.
Third-party hosting, domain or software charges may have separate cancellation and refund rules.
11. Our Cancellation
If omgcodex is unable to continue a project for reasons within our control, we will communicate with you and, where appropriate, discuss options such as:
- Completing the remaining work;
- Transferring completed work;
- Rescheduling the project; or
- Providing an appropriate refund for services that have been paid for but not performed.
Any refund will take into account work already completed and costs already incurred, subject to your rights under applicable law.
12. Australian Consumer Law
If the Australian Consumer Law applies to your purchase or service, you may have consumer guarantees and remedies that cannot be excluded by a business.
Nothing in this Refund Policy is intended to:
- Remove your statutory rights;
- Prevent you from exercising a legal remedy;
- Exclude consumer guarantees that cannot legally be excluded; or
- Restrict any right or remedy that must legally remain available to you.
If a service fails to meet an applicable consumer guarantee, your legal rights may include a repair, correction, replacement, refund or other remedy depending on the circumstances and applicable law.
13. How to Request a Refund

- Invoice or payment reference, if available;
- Reason for the refund request; and
- Any relevant supporting information.
We may request additional information to properly assess your request.
14. Refund Assessment
We will review refund requests individually based on:
- The service purchased;
- The agreed scope;
- The amount of work completed;
- The stage of the project;
- Payments already made;
- Third-party costs incurred;
- The reason for cancellation or refund;
- Any applicable project agreement; and
- Any rights you have under applicable law.
We aim to respond to refund requests within a reasonable period.
15. Approved Refunds
If a refund is approved, we will generally return the approved amount using the original payment method where reasonably possible.
The time required for the refund to appear in your account may depend on the payment provider or financial institution.
Any non-refundable third-party charges or amounts relating to work already completed may be deducted where legally permitted.
16. Disputes
If you believe a refund has been incorrectly refused, please contact us first so that we can review the matter.
We encourage clients to resolve concerns directly with omgcodex before pursuing external dispute-resolution options.
Nothing in this section prevents you from exercising any rights available to you under applicable Australian law.

We may update this Refund Policy from time to time to reflect changes to our services, business practices or applicable legal requirements.
The latest version will be published on this page with an updated “Last updated” date.
For an existing project, any specific refund or cancellation terms agreed in writing may continue to apply to that project.
